Article 1 : Price

1.1 The prices of our products are indicated in euros (EUR), all taxes included (tax included) excluding participation in processing and shipping costs.

1.2 For any delivery to a country other than mainland France or a member state of the European Union, you are the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Ambiance Canada. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to find out about these aspects from your local authorities.

1.3 Ambiance Canada reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in effect at the time of the registration of orders.

1.4 The products remain the property of Ambiance Canada until full payment of the price.

Article 2 : Command

Article 3 : Validation

You declare that you have read and accepted these General Conditions of Sale before placing your order. The validation of your order therefore implies acceptance of these General Conditions of Sale.

Your order is only validated after online payment of the latter.

No payment on delivery is possible.

Article 4 : Availability


Our product offers and prices are valid as long as they are visible on the site, while stocks last.
 
In the event of a stock shortage, Ambiance Canada will decide to send you the order and immediately reimburse the missing product (s), or may contact you by email or telephone to arrange an exchange.

Article 5 : Delivery

We deliver in France and more widely in Europe.

We do our best to dispatch orders as quickly as possible (maximum 4 open days after your order). If however we encounter a problem, we will contact you as soon as possible. It is your responsibility to verify the delivery information that you provide.

In the event of an order that is too large for the chosen mode of transport, or too fragile, we allow ourselves the right to dispatch your order to you by road carrier.

In this case, you must be present during the delivery driver's visit. We systematically ask the transport company to call you to arrange an appointment.

The products are delivered to the delivery address that you indicated during the ordering process. The times indicated on the "Delivery" page are the usual average times and correspond to the times of shipment processing, to which is added the delivery time.

We also invite you to regularly consult your order tracking and to call Customer Service for any questions or in the event of a problem.

In the event of payment by bank card, the times indicated are average times and correspond to the times of dispatch and routing (on the page "Times and costs of delivery") for the products bound for metropolitan France.

Regarding complaints following transportation incidents, Ambiance Canada cannot be held responsible for any inconvenience caused by the carrier you have chosen.

However, we will keep in touch with you and try to resolve the problem as soon as possible.

 

 

Article 6 : Delivery complaints


Parcel delivered out of time:

Ambiance Canada cannot be held responsible for the delivery times of the carrier chosen by you.

However, we remain at your disposal to conduct an investigation with the responsible services to find out the reasons and keep you informed of the progress of your package as soon as possible.

No delivery due to address error:

If the error is caused by Ambiance Canada, we will re-send the package to you upon receipt at our expense.

If the error is your fault, we will be obliged to ask you to pay the actual shipping costs of the second shipment.

Packages returned after the time limit for proceeding:

If you do not go to your post office within 15 days of receipt of the postman's notice for colissimo delivery and 7 working days after delivery for Chronopost, the package is automatically returned to us. Note that this period is 7 working days at a relay point and 3 days at a Pick up station.

In the event of a return due to an exceeded deadline, the return costs will be borne by the customer in the event of cancellation of the order. These are established by the carrier (and not Ambiance Canada) and are 20 € TTC.

In this case the terms will be the same as for non-delivery due to an address error (above).

Lost package:

If the carrier lost your package, we undertake to open an investigation with their complaint service, and once this loss has been confirmed by them, we will send your order back to you at no additional cost.

To do so, you must send us by post or email a copy of your identity card and a handwritten letter indicating on your honor that you have not received this said package and that you agree to refuse the first package in in case it is distributed to you afterwards.

Damaged package:

It is your responsibility to check the contents of your package upon receipt of it, before the postman or merchant of the relay point.

Thus, you can draw up a report with the representative of the carrier to carry out the steps of complaint of the inconveniences for which he is solely responsible.

If the delivery person drops a seemingly damaged package you can:

- refuse it and ask to make a report with the latter. This approach makes it possible to process the complaint and return a second parcel much faster.

- Open it in front of the postman so that he can see with you the number of damaged items and complete a report. (The postman or deliveryman has the obligation to remain to observe the deterioration with you if you request it).


Article 7 : Payment

Payment for your purchases is made:

By bank card: Carte Bleue, Visa, MasterCard.

You will then need 3 data: the 16 digits of your bank card, the expiration date and the cryptogram on the back.

We do not have access to the bank data that you enter, and they are never saved.

No payment by check will be accepted.

Article 8 : Security

Article 9 : Right to retract

You have the right of withdrawal fourteen (14) days from receipt, provided by law, to return the items to us without having to justify a reason.

The return costs will be your responsibility, and only the price of the product (s) purchased will be refunded within fourteen (14) days.

You must first contact our after-sales service.

The products must be returned in their original condition and accompanied by a copy of the invoice.

Items returned incomplete, damaged, damaged or soiled by the customer are not accepted.

Article 10 : Product conformity

We undertake to reimburse you (by bank return or by credit note), or to exchange products that do not correspond to your order.

In this case, thank you for contacting the after-sales service to inform us in detail by email, accompanied by at least one color photograph.

Ambiance Canada will decide to exchange, compensate or reimburse the product (s). The request must be made within fourteen (14) days of delivery. Any complaint made after this time cannot be accepted.

In the event of an error on our part, Ambiance Canada will decide to send you a Colissimo return label, at its expense for the exchange, or to reimburse you for the item not received.

If we forget to do so, Ambiance Canada will either decide to return the missing item to you (at its expense) or refund it to you in the form of a credit note.

Finally, in the event of a product damaged by transport, Ambiance Canada undertakes to take all necessary steps with your carrier to obtain reimbursement for the products.

In this case, please attach to your request by email 3 photographs: Package with visible label, the product in its original packaging and the damaged product.

In accordance with Law 80-335 of May 12, 1980, the goods remain the property of the seller until payment.

Article 11 : Refund

Refunds of products in the cases referred to in articles 8 and 9 will be made within fourteen (14) days or less after receipt of the products by us.

Reimbursement will be made at the discretion of Ambiance Canada by credit to your bank account or by bank check addressed to the name of the customer who placed the order and to the billing address. No cash on delivery will be accepted, whatever the reason.

Article 13 : Responsibility

The products offered comply with current French legislation. Ambiance Canada cannot be held liable in the event of non-compliance with the legislation of the country where the products are delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products you plan to order.

Photos are for illustrative purposes. We invite you to refer to the description of each product to know its precise characteristics. Do not hesitate to contact us in case of doubt or if you would like further information.

Article 14 : Protection


The elements contained on this site, in particular the texts, illustrations and photographs cannot be the object of any use, modification, alteration, partial or total reproduction and more generally of any exploitation without the express agreement of the company Ambiance Canada.

Article 15 : Applicable law disputes


This agreement is subject to French law. The language of this contract is French. Any dispute will be the exclusive competence of the Commercial Court of Clermont-Ferrand, only competent, whatever the place of shipment.

The information and data concerning you are necessary for the management of your order and for our commercial relations. This information and data is kept for security purposes, in order to comply with legal and regulatory obligations and also to allow us to improve and personalize the services we offer and the information we send to you.
